Terms of Service

Agreement and eligibility

These Terms of Service govern use of this website and purchases from McBride Restaurant Consulting LLC ("McBride"). By using the website, submitting a booking, accepting an agreement, or completing a purchase, you agree to the terms incorporated into that action. You must be at least eighteen years old and legally able to enter a binding agreement.

Offers, bookings, and payment

The one-time consultation is a twenty-to-thirty-minute fit call costing $64.99. A requested appointment is not confirmed until the consultation terms are accepted, payment succeeds, and McBride confirms availability. The three fixed-period partnership plans require acceptance of the Consulting Services Agreement, Recurring 28-Day Payment Authorization and Prorated Refund Addendum, and applicable Statement of Work. PayPal charges the setup fee and first period when the plan begins, then the stated amount every 28 days for a fixed number of charges. Each plan ends automatically after its final charge and does not renew indefinitely. This website does not receive or store complete payment-card credentials.

You agree to provide accurate contact, order, and payment information. McBride may reject or cancel an order affected by an obvious pricing error, suspected fraud, unavailable service, unlawful request, or material misrepresentation. If McBride cancels a paid order without customer breach, the unused payment will be refunded.

Service-specific terms

The paid fit call incorporates the One-Time Consultation Terms. Paid consulting incorporates a signed Statement of Work and the Consulting Services Agreement. Fixed-period consulting also incorporates the Recurring 28-Day Payment Authorization and Prorated Refund Addendum. Coaching purchases incorporate the Coaching Terms. Digital-product purchases incorporate the Digital Product Terms and License. If these general website terms conflict with a service-specific agreement, the service-specific agreement controls for that purchase.

Acceptable use and intellectual property

The website, brand, copy, designs, checklists, templates, methods, and downloadable materials belong to McBride or its licensors. You may not interfere with the website, bypass purchase controls, copy or scrape content for resale, impersonate another person, submit unlawful material, introduce malicious code, or use McBride materials beyond the license granted for the purchase.

Third-party services

The website may link to or embed PayPal and other third-party services. Their availability, security, privacy practices, and terms are controlled by those providers. A link does not make McBride responsible for a third party's acts or systems.

Disclaimers and liability

The website is provided on an "as is" and "as available" basis to the fullest extent permitted by law. McBride does not guarantee uninterrupted access, error-free operation, or a particular business, financial, employment, or management result. Service-specific warranty disclaimers and liability limits apply in addition to this section.

To the fullest extent permitted by law, McBride is not liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from website use. McBride's aggregate liability for a website-only claim will not exceed the amount paid for the purchase giving rise to the claim. Limits do not apply where prohibited by law or to fraud, gross negligence, or willful misconduct.

Changes, suspension, and governing law

McBride may update these website terms prospectively by posting a new version. The version accepted for a completed purchase remains attached to that acceptance unless the parties agree otherwise. McBride may suspend website access to protect users, comply with law, prevent fraud, or maintain the service. Washington law governs, and court proceedings must be brought in an eligible small-claims court or a state or federal court located in King County, Washington.

Information practices

Privacy Policy and Cookie Disclosure

Information collected

McBride collects information you provide when requesting or purchasing services, including your name, business or restaurant name, email, phone number, role, booking date and time, goals or coaching topic, selected offer, quantity, and other information you enter. After payment succeeds, McBride may record your typed legal name, email, business, selected offer, agreement versions, terms snapshot, booking details, acceptance identifier and timestamp, and limited technical information. Fixed-period records may also include the setup fee, recurring charge, fixed charge count, maximum plan total, enrollment and renewal dates, cancellation date, unused days, refund calculation, PayPal subscription and transaction identifiers, receipts, executed Statement of Work, delivery record, and associated private client folder.

PayPal separately collects and processes payment credentials and transaction information. McBride may receive payment confirmation, payer contact information, amount, status, and transaction identifiers from PayPal, but does not store complete card or bank-account credentials on this website.

How information is used

Information is used to process bookings and purchases, deliver digital products, provide consulting or coaching, record contractual consent, communicate about orders, prevent fraud, handle cancellations or disputes, maintain tax and business records, improve the service, and comply with legal obligations.

Disclosure

McBride may disclose information to payment processors, hosting and technology providers, professional advisers, and other service providers that reasonably need it to perform work for McBride. Information may also be disclosed with your direction, to comply with law or legal process, to investigate fraud or misuse, to protect rights or safety, or as part of a sale or reorganization of the business. McBride does not sell customer personal information.

Cookies and similar technology

The website uses essential browser storage and technical data needed for booking flow, security, agreement acceptance, and website operation. PayPal may set its own cookies or similar technologies when its hosted payment features load. This site does not currently use advertising cookies or sell data for cross-context behavioral advertising. If analytics or advertising technology is added later, this disclosure and any required consent controls will be updated before use.

Retention and security

McBride retains agreement acceptances, order records, invoices, and related business records for up to seven years after the transaction or end of the customer relationship when reasonably needed for tax, accounting, contract, fraud-prevention, or legal purposes. Inquiry and booking information that does not lead to a purchase may be kept for up to two years unless a longer period is reasonably necessary. McBride uses reasonable administrative and technical safeguards, but no internet system can be guaranteed completely secure.

Your choices

You may request access, correction, or deletion of personal information by emailing mcbridejoshua7@gmail.com. McBride may verify the request and may retain information required for legal, tax, security, contract, or dispute purposes. Marketing email, if offered, will include an unsubscribe method. This website is not directed to children under eighteen and McBride does not knowingly collect their information through these services.

Purchase policies

Refund and Cancellation Policy

One-time consultation

The twenty-to-thirty-minute fit call costs $64.99 and must be paid before confirmation. With at least twenty-four hours' notice, the customer may reschedule once without charge or cancel for a full refund. Cancellations with less than twenty-four hours' notice, no-shows, or arrival more than ten minutes late are nonrefundable except where required by law or where McBride agrees otherwise. If McBride cancels and cannot reasonably reschedule, the consultation fee will be refunded.

Fixed-period consulting plans

One period is exactly 28 consecutive calendar days. The 12-Period Partnership is $520 setup plus 12 charges of $262.50, with $782.50 initially due and a $3,670 maximum. The 6-Period Partnership is $520 setup plus 6 charges of $280, with $800 initially due and a $2,200 maximum. Weekly Operator Support is $520 setup plus 6 charges of $1,105, with $1,625 initially due and a $7,150 maximum. Each finite plan ends automatically after its final charge. A client may cancel future charges at any time. If cancellation occurs during a paid period, the refund equals the current period charge multiplied by unused whole days and divided by 28. The setup fee is refundable before onboarding begins and earned once onboarding begins, except as required by law or for McBride's material failure. Manager workshops and implementation days

A two-hour Restaurant Operations Session is $260. A four-hour Restaurant Operations Intensive is $500. A three-hour Manager Workshop is $390. A Restaurant Implementation Day of up to eight hours is $1,040. Each is paid in full before confirmation. With at least twenty-four hours' notice, the client may reschedule once without charge or cancel for a full refund unless the Statement of Work states a different client-specific rule. Late cancellations and no-shows are nonrefundable except where required by law or where McBride agrees otherwise. These one-time services do not renew automatically.

Travel and additional work

Fixed-period sessions are preferably in person and may be delivered through Microsoft Teams based on location and scope. The first thirty minutes of travel each way from Kirkland are included. Additional round-trip travel is $50 per additional thirty-minute increment beyond the included sixty minutes, rounded up; disclosed parking and tolls are additional. Extra work requires written approval and is billed at $130 per hour in thirty-minute increments unless the Statement of Work states another rate.

Digital coaching

Coaching may be rescheduled once or canceled for a full refund with at least twenty-four hours' notice. Requests received less than twenty-four hours before the session are nonrefundable and may be rescheduled only at McBride's discretion. A participant more than fifteen minutes late may be treated as a no-show, and late arrival does not extend the scheduled end time.

Digital products

Digital-product sales are final after the file or access link is sent, downloaded, or accessed because the product can be copied immediately. Exceptions apply to duplicate charges, delivery of the wrong product, a materially corrupted file that cannot be replaced within a reasonable time, or a refund required by law. Delivery or file problems must be reported within seven days after purchase.

How to request a cancellation or refund

Email mcbridejoshua7@gmail.com with the customer name, order email, purchased service or product, booking date when applicable, PayPal transaction information, and the requested resolution. Approved refunds are returned through the original payment method and may take additional time to appear because of payment-processor or financial-institution timelines.

Coaching and Consulting Disclaimers

Manager coaching

Digital coaching is educational professional-development guidance for restaurant managers. It is not therapy, crisis counseling, medical care, legal advice, accounting or tax advice, employment-law advice, a formal human-resources investigation, or regulatory-compliance advice. The participant remains responsible for workplace decisions and should use qualified professionals or emergency resources when the situation requires them. Coaching communications are private but are not legally privileged.

Restaurant consulting

Consulting provides operational observations, analysis, recommendations, and planning based on information supplied by the client. McBride does not act as the restaurant's attorney, accountant, employer, manager, food-safety certifier, insurer, or fiduciary. The client controls implementation and remains responsible for employment, wage-and-hour, food-safety, licensing, privacy, financial, and other legal compliance.

No guaranteed results

McBride does not guarantee revenue, profit, labor savings, food-cost savings, sales growth, employee retention, promotion, conflict resolution, or any particular result. Restaurant and management outcomes depend on implementation, staffing, market conditions, customer demand, vendor performance, accurate inputs, applicable law, and other factors outside McBride's control.
